Tablescape Rendezvous 4 Two Pop-Up Experience
(Please Read Prior To Booking. Thank you.)
The following terminology applies to this Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “You” and “Your” refers to you, the person accessing this contract and accepting a Tablescape Rendezvous 4 Two Pop-Up Picnic Event, which is a service of D&C Marriage Enrichment, Inc. To Terms and Conditions. “Ourselves,” “We,” and “Us,” refers to D&C Marriage Enrichment, Inc. and/or DBA Tablescape Rendezvous 4 Two Pop-Up. “Party,” “Parties,” or “Us,” refers to both you the “Client” and “Ourselves,” or either the “Client” or “Ourselves.” Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
Because our services may evolve over time; our services may change or be discontinued, at any time and without notice, at our sole discretion. By booking your pop-up, you are saying you understand and agree to these terms.
D&C Marriage Enrichment, Inc. designs and creates Tablescape Rendezvous 4 Two luxury pop-up designs in Atlanta and surrounding local cities (Contact a representative for locations). You understand and acknowledge that the information listed in this contract related to each pop-up including descriptions and photographs are for informational purposes only and are not guaranteed to look exactly the way they are shown on our website or social media platforms. We offer a variety of pop-up. Therefore, each pop-up experience will be different. Each of the locations used in connection with the pop-ups may employ their own rules, conditions, waivers and other obligations with which You must comply, including dress code, footwear and alcoholic beverage and food consumption restrictions. You understand and acknowledge that You have complete oversight over Your person and property throughout Your participation in any pop-up related activities and as such release Us from all liability related to activities that are wholly under Your control.
You understand and acknowledge that due to circumstances beyond our control, We may be required to change vendors used as add-ons or general add-ons listed on our website from time to time. If such a change results in a material change to the nature, type of food, or rental items included in a pop-up experience purchased by You, We will contact You promptly about the substituted food/items. Notwithstanding anything to the contrary in these Terms and Conditions, in the event that such substituted food or items are not acceptable to You for any reason, You may not obtain a refund for Your purchase, but You may reschedule a different, comparable pop-up experience at the sole discretion and approval of D&C Marriage Enrichment, Inc.
Upon reading and agreeing to this contract, You agree to immediately pay a non-refundable charge and non-transferrable charge. Option charges are either $215.00 or $225.00 or $235.00 or $245.00 or whatever additional specialty agreed upon price (USD) depending on Your event need to secure Your pop-up date, time, and a pop-up for two (2) people. You agree not to add more people to the pop-up unless you have booked and purchased additional settings. Any additional settings are $25 per guest up to four (4) guests total. A non-refundable payment for all additional guests and additional hours is required at the time of the booking. Note: Should You require a pop-up experience for more than four (4) guests or larger, please let Us know and We can schedule a 30-minute consultation. The consultation fee to discuss larger or specific pop-up events is $45 per every 30 minutes.
Each pop-up picnic is for at least two (2) hours. Any additional hours are $40 per hour up to a maximum of two (2) additional hours total. Should You require an event longer than four (4) hours, please let Us know.
Any Add-ons may be requested up until one (1) week before the pop-up date. All requested Add-ons must be paid within one week of a booked pop-up date or there is no guarantee the Add-ons will be available.
If travel for a specific location requested by You and agreed upon by D&C Marriage Enrichment, Inc.is less than 10 miles, no additional travel fee will be assessed. If Your chosen location is more than 10 miles, but less than 25 miles, the following travel fee invoice will be prepared and sent to You in addition to your initial booking:
11 - 25 miles round trip - $25
Any location travel over twenty-five (25) miles must be approved first by D&C Marriage Enrichment, Inc. before a booking is accepted. Long distance bookings will be assessed a $25 fee plus $0.95 per miles not exceeding seventy-five (75) miles. D&C Marriage Enrichment, Inc. reserves the right to reschedule any Tablescape Rendezvous 4 Two Pop-Up requiring travel beyond fifteen (15) plus miles, due to unpredictable traffic time constraints.
In the event Client fails to remit payment as specified, to D&C Marriage Enrichment, Inc. for a Tablescape Rendezvous 4 Two Pop-Up shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and no longer assist Client. All fees and expenses associated with your pop-up booking must be paid in full prior to your pop-up experience.
D&C Marriage Enrichment, Inc. does not offer refunds for any Tablescape Rendezvous 4 Two Pop-Up within Our approved mileage boundaries once payment has been received. Should You need to reschedule Your pop-up for any reason, You must do so within one (1) week of your scheduled pop-up date. If “You” miss a scheduled pop-up for any reason and “You” have not already undertaken to reschedule the Tablescape Rendezvous 4 Two Pop-Up in accordance with these Terms and Conditions; the Tablescape Rendezvous 4 Two Pop-Up will be considered forfeited and any/all payments “You” have made in connection with such Tablescape Pop-Up shall be surrendered.
You agree to handle everything in the set-up with care and not misuse any items. You agree Not to change what has been prepared for your pop-up experience. Should any items used during your pop-up experience provided by D&C Marriage Enrichment, Inc. be damaged; You agree to pay for any damages incurred during Your pop-up experience, including but limited to broken items, soiled items, `unreasonable clean up, etc. We reserve the right to collect charges associated with damage or extra cleaning. You will be sent an invoice for any damaged items and expected to pay said invoice within five (5) business days from the invoice date.
All reservations are weather permitting. Atlanta weather is often unpredictable and ever changing. In the event of rain in the forecast, we will do all we can to accommodate a dry pop-up either by moving the location to an indoor space or by rescheduling You to another day and time. We will contact You if weather becomes an obvious concern and impact. If no reasonable accommodation or change can be agreed upon on the day of the original booking, We will do Our best to reschedule you within (2) months after your original booking.
Note: If Your pop-up is underway and the weather changes within 30 minutes of your booking, we will do Our best to reschedule you up until two (2) months after your original booking. You will not be refunded or rescheduled due to changes in weather during the scheduled time of Your pop-up event if the weather changes at least sixty (60) minutes into the event.
If We are unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation acts of God, inclement weather, strikes, lockouts, bushfires, fires, floods, traffic accidents, riots, pandemics, civil commotion or unrest, acts of government, interference by civil or military authorities, terrorist attacks or act of war) We may give written notice to that effect to the You, giving full particulars of such force majeure in which case Our (D&C Marriage Enrichment) obligations under these Terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. We shall not be liable for any loss or damage suffered by You as a result of any delays caused by such force majeure events nor will We be liable for loss or damage suffered by You in the event of the Client cancelling or postponing due to a force majeure event.
IMAGE RELEASE/WEBSITE INFORMATION
In the event that photographs of Your Pop-up Package have been taken, We reserve the right to use such photographs in its promotional materials and/or share either on Our social media platforms or wherever We determine is professional and necessary for the promotion of Our business.
Your use of any information or materials on this website is entirely at Your own risk, for which We shall not be liable. It shall be Your own responsibility to ensure that any products, services or information available through this website meet Your specific requirements.
CODE OF CONDUCT
By purchasing a pop-up experience, You agree that You will conduct Yourself in an appropriate manner before, during, throughout or after the course of Your participation in the Pop-Up service. You agree that You will not engage in activity or behavior that:
1. (a) is untrue, inaccurate, defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity;
2. violates the rules or codes of conduct of the location, including excessive intoxication or consumption of alcoholic beverages when consumption of alcoholic beverages is expressly forbidden;
3. is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity; and
4. advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations).
We cannot and do not assure that other participants or other visitors of Your chosen location are or will be complying with the foregoing Code of Conduct or any other provisions of these Terms and Conditions, and, as between You and Us, You hereby assume all risk of harm or injury resulting from any such lack of compliance.
We shall in no way be held responsible or be held accountable for any damage, injury, death or loss of income caused to You, any third parties or properties due to the hire of equipment by Us or services provided by Us. All equipment is hired and is Your responsibility until returned to the Us.
AMERICANS WITH DISABILITIES ACT
D&C Marriage Enrichment, Inc. regretfully makes no warranty or representation as to whether or not the pop-up locations or any of the activities comprising the pop-up experience comply with the Americans with Disabilities Act (ADA) or any similar legislation. However, should You have any special needs or requests for Your pop-up experience, please make this known upon booking and we will do Our best to serve You.
You acknowledge that the services We provide as part of Tablescape Rendezvous 4 Two Pop-Up are protected by copyright, trademark, trade secret and other laws of the United States. Except as expressly authorized herein, You may not reproduce, transmit, sell, display, distribute, publish, broadcast, circulate, modify, disseminate or commercially exploit the website, mobile app, and any and all content produced by Us in any manner (including electronic, print or other media now known or hereafter developed) without our written consent. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary-rights notices incorporated in or accompanying any of Our products, services or in any of Our content.
You have a non-exclusive, revocable license to access any of Our content for Your personal use, including this website, on the express condition that You comply with the terms of these Terms and Conditions.
D&C Marriage Enrichment, Inc. wants our customers and guests to feel 100% comfortable. We place your health and safety as our top priority. Here are the steps we’re taking to help everyone feel safe:
All tables, chairs, pillows, blankets, rugs, and containers are disinfected after each pop-up and all linen napkins, utensils, glasses, and dishes are washed before and after each experience as well (as will always be our policy). Each pop-up is prepared with new glasses, utensils, and napkins.
Tablescape Rendezvous 4 Two Pop-Up staff will wear face masks and gloves when setting up and tearing down pop-ups. We will continue social-distancing efforts when setting pop-ups up in public areas, even if it is not officially mandated.
We make no assumptions or claims in connection with our vendors and add-ons regarding Covid 19 precautions and standards.
Note: Although, We cannot promise that your pop-up area will be private as many of our locations are public; but we will do our best to provide the ambiance for a great pop-up event.
You agree that Your use of Our services constitutes Your electronic signature, acceptance, and agreement under the United States federal E-SIGN legislation and will meet the requirements of an original signature. You may not raise the use of an electronic signature as a defense to the enforcement of this Agreement.
The terms of this agreement shall be binding upon the heirs and assigns of both parties. This is a non-refundable purchase. We do offer rescheduling, as long as it aligns with the stipulations listed in this contract and availability. By purchasing, you agree to our full terms of service.
